Happy Polygon Privacy Policy

EFFECTIVE: MAY 25, 2018

INTRODUCTION

Happy Polygon, LLC ("Happy Polygon", "we", or "us") is a video game development and publishing company. Happy Polygon provides entertainment services in the form of mobile, online and downloadable products and services ("Products"). These Products are produced for use by users ("you"). This Privacy Policy sets forth our policy with respect to information that is collected from you when using our Products. Under applicable law, Happy Polygon, LLC is the "data controller" of personal data collected through the Products.

INFORMATION WE COLLECT

When using our Products, we may collect information from you, as further described below:

Information You Provide:
-Your email address, username, country, date of birth, telephone number, password;
-Security questions and answers;
-Demographic details, for instance in response to surveys about our Products;
-Information you provide when seeking help from us such as your name and records of the issues you experience;
-Billing information, such as your name, address, telephone number, payment card number, and payment account details; and
-Information you provide to enter a contest or sweepstakes. If you win, we may need to collect your social security number, postal address and/or national identification for eligibility, prizes delivery and tax purposes.

When you participate in social features (such as forums and chat), the information you disclose is public information. We may store and access it, and it may be read, copied, collected or used by other users without your consent.

OTHER INFORMATION WE COLLECT WHEN YOU USE OUR PRODUCTS

We collect other information automatically when you use our Products, including but not limited to:

-IP Address;
-Current City and Country Geo-Location;
-Mobile and other hardware or device identifiers;
-Platform type;
-Information about your media, device, hardware and software, such as your hardware settings and components;
-Device event information, including crash reports, request and referral URL's and system activity details (e.g. whether you encountered an error playing our games or lost Internet access); and
-Elements of your product experience (e.g. levels played, numbers of wins/losses, gameplay actions and choices made and executed).

We also collect and store information locally on your device, using mechanisms like cookies, browser web storage (including HTML 5) and application data caches. We may use third party web site analytic tools such as Google Analytics that employ cookies to collect certain information concerning your use of our Products. Cookies may be disabled by you by changing your web browser's settings, or disabling the "data reporting" option in our mobile or downloaded Products. Disabling cookies or data reporting may result in a degradation of a product's experience due to required the use of generalized data for data driven events.

Third Parties

We may receive information from third parties, like Twitter, Facebook and Apple services when you use our Products. We may also receive information from other players when they choose to share that information with us. This information will not be shared with non partnered entities or relevant law enforcement.

WHERE INFORMATION IS PROCESSED

Happy Polygon is based in the State of Texas ("Texas") and the United States ("the U.S."). No matter where you are located, you consent to the processing and transferring of your information in and to the U.S. and other countries. The laws of Texas, the U.S. and other countries governing data collection and use may not be as comprehensive or protective as the laws of the country where you live.

OUR USE OF YOUR INFORMATION

We use this information in the following ways:

To better operate our business and enhance your use of our Products, including:
-Improve to our business operations;
-Improve gameplay experiences;
-Provide social gameplay experiences like match-making;
-Measure the health of our Products;
-Identify, fix and troubleshoot bugs and product errors;
-Provide software updates;
-Help keep our products safe and fair, including the investigation and effort to curb fraud, illegal behavior and cheating.

To provide you with, including:
-Help identify and troubleshoot problems with your negative product experiences;
-To survey your opinions through surveys or questionnaires;
-Communicate with you and respond to your specific correspondence;

OUR DISCLOSURE OF YOUR INFORMATION
Happy Polygon is not a business for selling information. We make video games and other similar experiences. We consider your privacy an integral part of that experience. We do not share your information with third parties except in the following possible scenarios:

-Business transactions. Should we sell our business or buy elements of another business, your information may be transferred.
-Consent. We have your consent to transfer the information to a third party.
-Related Companies. We may share your information with any partner companies, consistent with this Privacy Policy.
-Agents, Consultants and Related Third Parties. We may need to hirer third parties to perform certain tasks for us. Your data may be necessary for this task.
-Legal Requirements. From time to time a legal request or obligation may appear. We will only honor those that we feel: (i) must comply with legally, (ii) protect and defend the rights or property of Happy Polygon or partner companies, (iii) protect the personal safety of users of our products or the public, or (iv) protect against legal liability.
-Aggregated or Non-identifiable DAta: We may also share aggregate or anonymized information with others for business purposes.

UNSOLICITED INFORMATION
You may provide us with ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, "Unsolicited Information"). All Unsolicited Information shall be deemed to be non-confidential and we shall be free to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution.

CHILDREN
Our products are for users age 13 and over and we do not knowingly collect personal information from children under the age of 13. If you are a parent or guardian of a child under the age of 13 and believe he or she has disclosed personal information to us please contact us at support@happypolygon.com. For the residents of the EEA, where processing of personal information is based on consent, we will not knowingly engage in that processing for users under the age of consent established by applicable data protection law. If we learn that we are engaged in that processing with such users, we will halt such processing and will take reasonable measures to promptly remove applicable information from our records.

LINKS TO THIRD PARTY SERVICES AND PRODUCTS
This Privacy Policy applies only to our products. The policies and procedures we described here do not apply to the Third Party Sites. Any links do not imply our endorsement of the Third Party Sites. Contact those sites directly for relevant information about their privacy policies.

DATA RETENTION
Data is retained by default for 24 months, but may be kept longer if still relevant to the purposes identified herein. To dispose of personal data, we may anonymize it, delete it or take other appropriate steps. Data may persist in copies made for backup or other business integrity related purposes.

SECURITY
Happy Polygon takes reasonable steps to protect the information provided by products from loss, misuse, unauthorized access, disclosure, alteration or destruction. However, nothing is ever truly secure, and transmission and storage may contain faults or errors. Take special care in deciding what information you disclose to us when using our Products or communicating with us via email.

CHANGES TO THIS PRIVACY POLICY
We reserve the right to update or modify this Privacy Policy at any time without prior notice. Please review this policy before providing us with any information. The last update is included in the date listed at the start of this policy. Your continued use of our products after any changes or revisions to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy. In some cases, direct affirmation may be required to continue use, and if affirmation is denied, then use of our Products may be denied.
